Welcome to tryprotokode.com (the "Site"), operated by M3K Expeditions LLC, doing business as PROTOKODE ("Company," "we," "us," or "our"). By accessing or using the Site or placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from us. By ordering, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Products and health disclaimer

We sell dietary supplements. Our products and related content are provided for general wellness and informational purposes only and are not medical advice. Statements about our products describe their intended effect on the structure or function of the body and are not claims to treat disease.

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare provider before starting any supplement, especially if you are pregnant, nursing, have a medical condition, or take medication. Individual results vary, and we do not guarantee a specific result.

3. Orders, pricing, and acceptance

All orders are subject to acceptance and availability. We may refuse, cancel, or limit an order, including where we suspect fraud, identify a pricing or listing error, or receive an address outside our service area.

Prices, product descriptions, and availability may change without notice. If we cancel an order because of an error or because we cannot fulfill it, we will refund the amount charged for the canceled order to the original payment method.

Customer-requested cancellations and changes are governed by our Refund & Quality Guarantee. Orders begin processing quickly and generally cannot be canceled or changed after placement.

4. Shipping, replacements, and returns

Shipping timeframes, service areas, and tracking are described in our Shipping Policy. Our replacement process and the fact that we do not accept returns or provide refunds for change of mind or lack of results are described in our Refund & Quality Guarantee. Both policies form part of these Terms.

5. Payment

By providing payment information, you authorize us and our payment processors to charge your chosen payment method for the total order amount, including applicable taxes. You represent that you are authorized to use the payment method provided.

6. One-time purchases and future subscriptions

At launch, all purchases are one-time orders. We may introduce optional subscription or auto-refill offers later. A subscription will apply only when you knowingly select it and agree to the price, frequency, renewal, and cancellation terms displayed at checkout. We will not convert a one-time purchase into recurring billing without your affirmative consent.

7. Acceptable use

You agree not to use the Site for an unlawful purpose, infringe our or another person's rights, introduce malicious software, scrape or copy content without permission, or interfere with the Site's operation or security.

8. Intellectual property

The Site and its content, including the PROTOKODE name, logos, text, graphics, and product imagery, are owned by or licensed to M3K Expeditions LLC and protected by intellectual property laws. You may not use, reproduce, or distribute our content without prior written permission.

9. Third-party links and services

The Site may link to or rely on third-party services, including fulfillment, payment, support, analytics, and marketing providers. We are not responsible for the content, policies, or practices of third-party websites.

10. Disclaimer of warranties

Except for the express quality commitment stated in our Refund & Quality Guarantee, the Site and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, M3K Expeditions LLC and its members, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or products.

To the maximum extent permitted by law, our total liability for a claim relating to a product or order will not exceed the amount paid for that order. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless M3K Expeditions LLC from claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site, violation of these Terms, or violation of law or a third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Any dispute arising from these Terms or use of the Site will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted. Your continued use of the Site after changes means you accept them to the extent permitted by law.
